Terms and Conditions

  1. Definitions

    1. Company: Refers to Document Translations Services or DTS.
    2. Services: Translation or any other services provided by the Company.
    3. Client: The party instructing the Company to provide the Services.
  2. Fees

    1. The Company typically quotes translation fees per page or per 1,000 words/characters of the source text.
    2. Translations are subject to a minimum charge. If a document needs to be sworn before a Solicitor or Notary, or apostilled, the Company will provide a quote for these services upon request.
  3. Payments

    1. Payments must be made by the Client within the agreed terms following the invoice date. One-off requests, first-time clients, and private individuals requiring certified translation services will generally be asked to pay before services are rendered.
    2. The Company reserves the right to charge a fixed late payment fee of 10% of the invoice value after the due date has passed. If full payment, including late fees and interest, is not received within thirty (30) days after the invoice due date, the debt will be transferred to a debt collection agency.
  4. Cancellation

    1. If translation or related work has not started, and the project has not been assigned to a translator, the Client may cancel the translation assignment in writing at no charge.
    2. If translation or related work has started, or the project has been assigned to a translator, the Client will be charged for work completed up to that point (at the agreed rate), plus any file engineering, administrative, and project management costs. If more than 50% of the assignment has been completed, the Company reserves the right to charge the full service quotation value. Where payments for translations have been made in advance, an admin fee of $75.00 will be applied upon refund.
  5. Revision Requests

    The Company will provide adequately qualified translators or linguists for the required Services. If the service does not meet the Client’s satisfaction, the Company will assess queries and, if necessary, revise/proofread the translated material at no extra cost. Quality issues should be raised within 30 days of submission.

  6. Translation Acceptance

    The Company does not offer refunds for issues related to the acceptance of translations. It is the Client’s responsibility to ensure that the translations meet the requirements of the receiving party. If the Client has any doubts, the Company strongly advises the Client to contact the Company with a list of their requirements before placing the order, so the Company can confirm that they meet them.

  7. Shipping

    The Company uses third-party shipping service providers for all shipments. If the Client becomes aware of an issue with their shipment, they should contact the Company immediately so the Company may assist in resolving the problem. Please note that the Company does not offer refunds for issues related to the handling of the Client’s shipment by third-party service providers.

  8. Confidentiality

    Both the Company and the Client will take reasonable precautions to ensure that all confidential information remains confidential.

  9. Non-Solicitation

    During the provision of the Services or for twelve months thereafter, the Client shall not solicit translators or linguists engaged in providing the Services.

  10. Force Majeure

    The Company shall not be liable for any failure to perform its obligations under this agreement if such failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, wars, strikes, or other force majeure events.

  11. Limitation of Liability

    The Company’s liability to the Client for any claim arising out of or in connection with the provision of the Services shall not exceed the amount of fees paid by the Client for the Services. In no event shall the Company be liable for any indirect, incidental, or consequential damages arising out of or in connection with the provision of the Services.

  12. Intellectual Property

    All intellectual property rights in the translations provided by the Company shall remain the property of the Company until full payment has been made by the Client. Upon full payment, the intellectual property rights in the translations shall transfer to the Client.

  13. Severability

    If any provision of this agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be deemed modified to the extent necessary to make it valid, legal, and enforceable.

  14. Governing Law

    These Terms and Conditions are governed by the laws of the State of New York. Any disputes will be resolved exclusively in the state or federal courts located in New York County, New York.
